    Has anyone been involved in creating a “legally defensible” Black Belt and/or Green Belt certification exam? If so, what are the costs and challenges?

    What do you mean by “legally defensible”? 
    As long as you do reasonable due diligence to ensure that you aren’t plagerizing someone else’s work I can’t imagine have a problem unless you are looking at something beyond what I would normally expect…

    Thanks for the reply.  Let me clarify what I mean by ¡§legally defensible¡¨:
     
    We are looking for any reason that either the certification test or the testing procedure could be challenged legally (i.e., law suit, etc.).  There may or may not be valid issues (other than plagiarism, as you mentioned) which other people had to deal with and we just thought we should ask before we plunge forward.

    Regarding the “legally defensible” issue as it pertains to the certification exams … keep in mind, you are developing a certification exam, not a licensure.  There is a major difference. Consider a PE (Professional Engineer) exam.  This is a professional licensing exam.Contrast that with the PMP (Project Management Professional) certification exam or acertification in Microsoft Office. Generally speaking, a certification exam merely indicates some level of knowledge or training has been met. Licensure is more formal and grants the legal right to practice some profession.  Whether proper or not, the two terms are frequently interchanged.
    I am presently developing Six Sigma training and Six Sigma certification courses.  My “legaly defensible” issues center around ensuring the material meets the generally accepted notion of Six Sigma.  For example, one cannot offer a course of study and examination void of any statistical discussions and claim it is a true Six Sigma certification.  The other issues are to ensure all work is original work or that proper references are made to materials used.  Alternatively, one could use commercial off-the-shelf books, but I would still strongly suggest you create your own certification exam.
    Finally, I suggest your material, particularly the certification examination, be challenging and force people to think.  In my humble opinion, far too many people obtain a certification and don’t have a clue what they are talking about.
