How determine defect vs. change in software

Present challenge in our project is to work with our vendor to determine what changes needed to the system are actual defects (vendor pays for the fix) vs. a change to what was asked for (we pay for the fix)Has anyone used a decision tree type of approach to drive the resolution of this this issue?
